Clinical Negligence Training

On 20th and 24th April 2018 I presented 2 courses for Liverpool Law Society. 

The first was an Introduction to Clinical Negligence which was aimed at those who are very new to the work either as young lawyers/paralegals or those who are thinking of transferring from other work, particularly in the light of the forthcoming changes to Personal Injury work. We looked at key principles including Breach of Duty and Causation. We explored the classic Bolam Test and the impact of the Montgomery v Lanarkshire decision in 2015.

The second was a course for experienced practitioners. We looked at recent cases in relation to issues including informed consent, quantum in wrongful birth cases and the application of the Bolitho test in relation to the need for medical opion to be reasonable and logical. We also looked at procedural matters including rules on service of a claim form and how things can go wrong, witness statements and trial bundles.
